This website (the “Site”) is operated under the trade name “Solo Reakt” (the “Seller”, “we”, “us” or “our”).

2. PURPOSE AND SCOPE
2.1. These terms govern the purchase of products through the Site and the use of the online checkout process.
2.2. If the buyer acts as a consumer (“Consumer”), mandatory consumer protection rules applicable in the Consumer’s country of habitual residence shall apply.
2.3. If the buyer acts as a business/professional (“B2B”), specific terms may apply; failing an express agreement, these terms shall apply with the particularities set out in the jurisdiction clause.
3. PRODUCTS, FEATURES AND USE
3.1. The Site sells products, including consumer electronic products. In particular, we may sell glasses with an integrated electronic system (e.g., built-in speakers and connectivity) (“Product(s)”).
3.2. Essential information about the Product (functions, compatibility, package contents, usage requirements, warnings and limitations) is shown on the product page and/or in the documentation provided with the Product. Images are for illustrative purposes and minor colour/finish variations may occur depending on screen settings or production batches.
3.3. If the Product incorporates or is interconnected with digital elements (software/firmware, connectivity, app or digital services), the Seller will provide, where applicable, relevant compatibility and interoperability information and any updates necessary to maintain conformity.
4. AGE REQUIREMENT AND LAWFUL USE
4.1. To purchase on the Site you must (i) be at least 18 years old or (ii) be of legal age in your country, and have legal capacity to contract.
4.2. Use of the Site for unlawful purposes or in bad faith is prohibited.
5. PURCHASE PROCESS, ERROR CORRECTION AND CONTRACT RECORD
5.1. The purchase process allows users to review the cart, enter billing and shipping details, select a payment method and confirm the order.
5.2. Before confirming the order, the user can identify and correct errors (e.g., address, quantities, shipping method) using the Site tools (cart/checkout) or by contacting support.
5.3. The contract is concluded when the Seller confirms receipt of the order via an order confirmation email. The Seller may keep evidence of the contract and order, and the user may request a copy via info@soloreakt.com
6. AVAILABILITY, ACCEPTANCE AND ORDER CANCELLATION
6.1. Orders are subject to stock availability.
6.2. The Seller may refuse or cancel an order only for objective reasons, such as: out of stock, obvious pricing errors, inability to deliver, reasonable suspicion of fraud, or technical issues. In case of cancellation, amounts paid will be refunded using the same payment method, unless technically impossible.
7. PRICES, TAXES AND INVOICING
7.1. Prices are shown in “EUR” and include applicable indirect taxes where appropriate (e.g., VAT). Shipping costs are calculated and displayed before checkout is completed.
7.2. If promotions or price reductions are offered, they will be communicated transparently and in accordance with applicable regulations.
8. PAYMENT METHODS
8.1. Available payment methods are shown at checkout.
8.2. Payment is processed through payment providers. The Seller does not store full card details when the provider acts as the payment processor/controller for payment processing.
9. SHIPPING AND DELIVERY
9.1. We ship to the countries indicated in the shipping policy and during the checkout process.
9.2. Delivery times are estimates and are shown at checkout or in the shipping policy.
9.3. Unless otherwise agreed, the risk of loss or damage passes to the customer when the customer, or a third party designated by the customer (other than the carrier), acquires physical possession of the goods.
9.4. If the order arrives with visible damage, we recommend notifying the carrier and the Seller as soon as possible to process the incident.
9.5. Unless a different timeframe has been agreed, delivery will take place without undue delay and, in any event, within 30 days from the date the contract is concluded.
10. RIGHT OF WITHDRAWAL (CONSUMERS)
10.1. If you are a Consumer, you have the right to withdraw from the purchase without giving any reason within 14 calendar days from the date you receive the Product.
10.2. To exercise the right of withdrawal, you must send an unequivocal statement (for example, by email to info@soloreakt.com) stating: name, order number, Product, and delivery/receipt date. You may use the model withdrawal form in Annex I.
10.3. Effects: We will refund the price paid for the Product and, where applicable, the standard delivery costs (not any surcharges for express/special delivery if you chose them) without undue delay and, in any event, within 14 calendar days from the day we are informed of the withdrawal. We may withhold the refund until we have received the goods back or until you provide evidence of having sent back the goods. We will issue the refund using the same payment method used for the initial transaction, unless the consumer has expressly agreed otherwise and provided the consumer does not incur any fees as a result of the refund.
10.4. Return costs: unless expressly stated otherwise, the direct cost of returning the goods shall be borne by the consumer.
10.4 bis. Return of the goods: The consumer must send back or hand over the goods without undue delay and, in any event, within 14 calendar days from the date on which they communicated their decision to withdraw from the sales contract. The deadline is met if the consumer sends back the goods before the 14-day period has expired.
10.5. Handling of the Product: the consumer shall only be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product (e.g., prolonged use, damage, missing parts).
10.6. Exceptions: the right of withdrawal may not apply in cases provided by law (for example, goods made to the consumer’s specifications or clearly personalised goods), where applicable.
11. RETURNS DUE TO LACK OF CONFORMITY AND LEGAL WARRANTY
11.1. If the Product is not in conformity with the contract (e.g., a manufacturing or functional defect), the Consumer is entitled to the legally available remedies (repair, replacement, price reduction or contract termination) in accordance with applicable law.
11.2. Time limits: the Seller will be liable for lack of conformity for the legal period applicable in the Consumer’s country. Where Spanish law applies, the liability period is 3 years from delivery for consumer goods.
11.3. Presumption of lack of conformity: where Spanish law applies, lack of conformity that becomes apparent within 2 years from delivery is presumed to have existed at the time of delivery, unless proven otherwise or incompatible with the nature of the goods or the defect.
11.4. Goods with digital elements: where the Product incorporates digital elements, the Seller will provide the updates necessary (including security updates) to maintain conformity for the legally required period and/or the period agreed, where applicable. The consumer must install the updates provided according to the instructions given.
11.5. After-sales service and spare parts (where Spanish law applies): legal obligations regarding availability of spare parts and technical service will be met for the periods provided by applicable regulations.
11.6. To manage a lack of conformity claim, the customer should contact info@soloreakt.com stating the order number, a description of the issue and, where possible, evidence (photos/videos).
12. COMMERCIAL WARRANTIES (IF OFFERED)
Any additional commercial warranty (if offered) will be described in writing, indicating its scope, duration and how to use it. This commercial warranty does not affect the legal warranty.
13. LIMITATION OF LIABILITY
13.1. Nothing in these terms excludes or limits any non-waivable Consumer rights or liabilities that cannot be excluded by law (for example, personal injury due to negligence, fraud, or any liability that the law deems non-excludable).
13.2. In B2B relationships, the Seller’s liability shall be limited to the maximum extent permitted by law and, except in cases of wilful misconduct or gross negligence, the Seller shall not be liable for indirect damages or loss of profit.
14. INTELLECTUAL PROPERTY
The contents of the Site (texts, images, trademarks, designs) are protected. Unauthorised reproduction or use is prohibited.
15. DATA PROTECTION
The processing of personal data is governed by our Privacy Policy and, where applicable, our Cookie Policy, available on the Site.
16. THIRD-PARTY LINKS
The Site may contain links to third parties. We are not responsible for their content or policies.
17. CHANGES TO THESE TERMS
We may amend these terms for legal, technical or operational reasons. The version in force will be the one published on the Site. For purchases already made, the version accepted at the time of purchase shall apply.
18. GOVERNING LAW AND JURISDICTION
18.1. Governing law: these terms shall be governed by Spanish law. However, if the buyer is a Consumer habitually resident in another State, this choice shall not deprive the consumer of the protection afforded by mandatory provisions of the consumer’s habitual residence when applicable.
18.2. Jurisdiction (Consumers): in disputes involving Consumers, the competent courts shall be those determined by the applicable rules on international jurisdiction and consumer protection.
18.3. Jurisdiction (B2B): in B2B relationships, the parties submit to the Courts and Tribunals of Barcelona, Spain, waiving any other jurisdiction that may apply.
19. LANGUAGE
These terms may be available in multiple languages. In case of discrepancy, the version displayed to the customer during the checkout process on the relevant Site shall prevail, without prejudice to the consumer’s rights.

If you are a Consumer, you may also use the out-of-court dispute resolution mechanisms available in your country, where applicable.
The above is without prejudice to shorter time limits that may be required by applicable law.
